About these terms
These are the terms that apply when you use vyve.club, place an order with us, or join the VYVE Club. By ordering from us or signing up for a subscription, you agree to these terms.
We've written them in plain English where we can. Where we've used legal language, it's because we have to.

About us
VYVE is operated by VYVE Nutrition Pty Ltd, an Australian company with an ABN registered in New South Wales. Our registered business address is in Sydney, Australia.

Orders & pricing
All prices on our website are in Australian Dollars (AUD) and include GST where applicable. Shipping is calculated at checkout.
When you place an order, you're making an offer to purchase. We accept your offer when we send you a dispatch confirmation email. Until then, we may decline an order for any reasonable reason, including:
- The product is out of stock
- There has been a pricing or description error
- We suspect the order is fraudulent or in breach of these terms
- We can't deliver to your address
If we can't accept your order, we'll refund any payment in full and let you know why.
Payment
We accept payment via the methods shown at checkout, including major credit and debit cards and supported buy now pay later providers. Payment is processed securely by Stripe and the relevant third party providers.
We don't store your full card details on our servers. By paying, you authorise us to charge the total order amount to your nominated payment method.
The Club subscription
Joining the VYVE Club means signing up to a recurring subscription. Here's how it works:
- You select a delivery frequency at sign up (typically every 4 weeks)
- We charge your nominated payment method on the day each order ships
- Members get 20% off the standard per can price and free standard shipping on every Club order
- You can pause, skip, or cancel at any time before your next charge date by managing your account or emailing us
- Cancelling prevents future charges but doesn't refund a charge already made
- If a Club order has already been dispatched, our standard returns policy applies
We'll let you know in advance if our Club pricing or perks change. You can cancel before any change takes effect.
Delivery
Delivery times, rates, and conditions are set out in detail on our Shipping & Returns page, which forms part of these terms.
Risk of loss passes to you when the carrier delivers the order to the address you provided. If you give us an incorrect address and the order is lost or returned, we may charge you for re shipment.
Returns
Our full returns and refund policy lives on our Shipping & Returns page. In summary: we don't accept returns on opened or partially consumed product for hygiene reasons, but we'll always make damaged or wrong orders right.
Nothing in these terms or in our returns policy excludes or limits your rights under the Australian Consumer Law.
Product use & safety
VYVE is a caffeinated energy beverage. It's not suitable for everyone. By purchasing, you confirm you understand and accept the following:
- VYVE is not recommended for children under 15, pregnant or breastfeeding women, or people sensitive to caffeine
- Recommended maximum: 2 cans per day. Don't mix with other high caffeine sources
- If you have a medical condition, are on medication, or are unsure whether a caffeinated beverage is right for you, consult your doctor before consuming
- Don't consume past the best before date printed on the can
- Store cool. Avoid prolonged exposure to direct sunlight or temperatures above 30°C
We do not provide medical advice. Information on our website about ingredients or effects is general in nature and is not a substitute for professional medical guidance.
Brand & content
The VYVE name, the VYVE logo, all designs, photography, copy, and other content on this website are owned by VYVE Nutrition Pty Ltd or licensed to us. You may not copy, reproduce, or use any of it for commercial purposes without our written permission.
Personal, non commercial use, like sharing our content on social media or saving an image for your own reference, is fine and welcomed.
Liability
To the maximum extent permitted by law, our total liability to you in connection with any order or these terms is limited to the price you paid for the order in question.
We are not liable for indirect, consequential, or special losses, including loss of profit, loss of opportunity, or loss of data. Nothing in this clause limits or excludes liability that cannot lawfully be limited or excluded, including under the Australian Consumer Law.
Disputes & law
These terms are governed by the laws of New South Wales, Australia. Any dispute will be dealt with in the courts of New South Wales.
Before any formal dispute, please contact us at hello@vyve.club so we can try to sort it out directly. We respond to every complaint and aim to resolve issues quickly and fairly.
Changes to terms
We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order. For Club subscriptions, we'll give you reasonable notice of any change that affects your subscription before it takes effect.
